Welcome to TekBay Academy Pvt Ltd. These Terms and Conditions govern your use of our Apprenticeship Program and related services. By accessing or using our platform, you agree to be bound by these terms. Furthermore, for the purposes of this document, TekBay Academy Pvt Ltd (PAN : 623530898) may be referred to as "TekBay Academy," and all such references shall have the same legal meaning.

1. Acceptance of Terms

By enrolling in the TekBay Academy's Apprenticeship Program, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, as well as our Privacy Policy. If you do not agree with any part of these terms, please do not use our services.

2. Program Enrollment

2.1 Eligibility

Our Apprenticeship Program is designed for fresh graduates, IT students, and early professionals looking to enter the cloud computing field. Participants must be at least 18 years of age or have parental/guardian consent.

2.2 Registration

To enroll in the program, you must provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. Program Fee and Refund Policy

3.1 Fee Structure

The program fee is 15,000 NPR for the onsite/physical classes of the AWS Solutions Architect Associate and the AWS Machine Learning Engineer Associate including the exam fee (worth approximately $150 USD). For pre-recorded or LMS sessions, the program fee is 12,000 NPR for the AWS Solutions Architect and the AWS Machine Learning Engineer Associate Exam including the exam fee (worth approximately $150 USD). For the DevOps Bootcamp the program fee is 55,000 NPR. Payment must be completed at the time of enrollment.

3.2 Refund Policy

The program fee is fully refundable if you successfully pass the AWS Solutions Architect Associate or AWS Machine Learning Engineer Associate certification exam. To claim your refund:

• You must complete the 8 or 10-week training program.
• You must pass the AWS certification exam on your first attempt.
• You must submit your official AWS certification within 30 days of passing the exam.

Refunds will be processed within 14 business days of verification.

3.3 Non-Refundable Circumstances

The program fee is non-refundable if you:

• Fail to complete the 8-week training program.
• Do not pass the AWS certification exam on your first attempt.
• Withdraw from the program before completion.
• Violate any terms of this agreement.
• Are enrolled in the DevOps Bootcamp Program.

4. Program Structure and Attendance

4.1 Duration

The AWS Solutions Architect Associate and AWS Machine Learning Engineer Associate programs run for 8 weeks (physical/online) or 10 weeks (pre-recorded/LMS). The DevOps Bootcamp runs for a duration as specified at enrollment.

4.2 Attendance

Regular attendance is expected. Consistent non-attendance may affect your eligibility for the refund policy. TekBay Academy reserves the right to update the schedule with reasonable notice.

5. Intellectual Property

All course materials, content, and resources provided by TekBay Academy are protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without explicit written permission from TekBay Academy Pvt Ltd.

6. Code of Conduct

Participants are expected to maintain professional and respectful behaviour throughout the program. TekBay Academy reserves the right to terminate any participant's enrollment for violations of this code, without any refund.

7. Limitation of Liability

TekBay Academy shall not be liable for any indirect, incidental, or consequential damages arising from your use of our platform or services. Our total liability shall not exceed the program fee paid by you.

8. Modifications to Terms

TekBay Academy reserves the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website. Continued use of our services after modifications constitutes acceptance of the updated terms.

9. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Nepal. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Nepal.
